Welcome to SkyPool Dubai. These Terms and Conditions govern your use of our website and the services we provide. By accessing our website or booking our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.
1. Definitions
In these Terms and Conditions:
- "Company," "we," "us," or "our" refers to SkyPool Dubai, a registered company in the United Arab Emirates (Registration No: 02524596).
- "Customer," "you," or "your" refers to the individual or entity purchasing or using our services.
- "Website" refers to skypooldubai.com and all its subdomains.
- "Services" refers to the pool experiences and related offerings provided by SkyPool Dubai.
- "Venue" refers to the location where the pool experience takes place.
- "Booking" refers to the reservation of a specific service on a specific date.
2. Booking and Payment
2.1 Booking Process
To make a booking, you must:
- Be at least 18 years of age or have parental/guardian consent
- Provide accurate and complete personal information
- Complete the booking process on our website or through an authorized representative
- Pay the applicable fees in full at the time of booking, unless otherwise specified
2.2 Booking Confirmation
Your booking is only confirmed when you receive a confirmation email from us. This email will contain details of your booking, including the date, venue, and experience type. Please check these details carefully and contact us immediately if there are any discrepancies.
2.3 Payment
We accept payment through the methods specified on our website. All prices are listed in AED (United Arab Emirates Dirham) and include applicable taxes unless otherwise stated. Additional fees, such as booking fees, may apply and will be clearly communicated before payment.
2.4 Price Changes
Prices are subject to change without notice. However, once your booking is confirmed, the price will not change unless there are modifications to your booking at your request.
3. Cancellations and Modifications
3.1 Cancellation by Customer
Cancellation policies vary by experience type:
- Standard Experiences: Full refund if canceled 48 hours or more before the scheduled date; 50% refund if canceled between 24-48 hours before; no refund for cancellations less than 24 hours before.
- Premium Experiences (VIP Infinity Pool Experience): Full refund if canceled 72 hours or more before the scheduled date; 50% refund if canceled between 48-72 hours before; no refund for cancellations less than 48 hours before.
- Special Events or Group Bookings: Custom cancellation policies apply and will be specified at the time of booking.
All cancellation requests must be submitted in writing to bookings@skypooldubai.com.
3.2 Modifications by Customer
Requests to modify your booking (change of date, time, or experience type) are subject to availability and must be made at least 48 hours before your scheduled experience. A modification fee may apply. For modifications made less than 48 hours before your scheduled experience, standard cancellation policies apply.
3.3 Cancellation or Modification by SkyPool Dubai
We reserve the right to cancel or modify a booking due to circumstances beyond our control, such as adverse weather conditions, venue closures, or safety concerns. In such cases, we will offer you the option to reschedule to another date or receive a full refund.
4. Service Usage and Conduct
4.1 Age Restrictions
Age restrictions vary by experience and venue:
- Experiences with bar access or designated as adult-only require guests to be 21 years or older.
- Family experiences allow guests of all ages, but children under 16 must be accompanied by an adult.
- Specific age requirements are clearly stated in each experience description.
4.2 Venue Rules
You agree to comply with all rules and regulations set by the venue, including but not limited to:
- Dress codes
- Safety procedures
- Behavior standards
- Photography restrictions
- Prohibited items
Failure to comply with venue rules may result in denial of entry or removal from the premises without refund.
4.3 Health and Safety
By booking our services, you acknowledge that swimming and pool activities involve inherent risks. You are responsible for:
- Ensuring you and your party are physically fit to participate
- Disclosing any medical conditions that may affect safe participation
- Supervising children in your party at all times
- Following all safety instructions provided by staff
- Not entering pools under the influence of alcohol or drugs
4.4 Personal Belongings
SkyPool Dubai and the venues are not responsible for any lost, stolen, or damaged personal belongings. We recommend using lockers or storage facilities provided by the venue and minimizing valuable items brought to the experience.
5. Liability and Indemnification
5.1 Limitation of Liability
To the fullest extent permitted by law, SkyPool Dubai shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profit, revenue, data, or business opportunities
- Any personal injury, illness, or death not directly caused by our negligence
- Any damage to or loss of personal property
- Any issues arising from third-party services or venues
- Any disruptions or inconveniences caused by circumstances beyond our reasonable control
In any case, our total liability shall not exceed the amount paid by you for the booking in question.
5.2 Indemnification
You agree to indemnify, defend, and hold harmless SkyPool Dubai and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from:
- Your violation of these Terms and Conditions
- Your violation of any third-party rights
- Your misuse of our services
- Any content or information you provide
6. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, videos, and software, is the property of SkyPool Dubai or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without our express written consent.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. By using our website or services, you consent to our collection and use of your personal information as described in our Privacy Policy.
8. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute through direct negotiation with SkyPool Dubai. If the dispute cannot be resolved through negotiation within 30 days, either party may proceed with legal remedies.
9. Force Majeure
SkyPool Dubai shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to:
- Natural disasters or extreme weather conditions
- Epidemics or pandemics
- Terrorist attacks, war, or civil unrest
- Government actions or restrictions
- Fire, flood, or other catastrophes
- Power failures or internet outages
- Labor disputes or strikes
In such circumstances, we will notify you as soon as possible and work to minimize the impact on your booking.
10. Modifications to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our website or services after such changes constitutes your acceptance of the modified Terms and Conditions. We recommend reviewing these Terms and Conditions periodically for any updates.
11. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
12. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any specific terms provided at the time of booking, constitute the entire agreement between you and SkyPool Dubai regarding your use of our website and services, superseding any prior agreements or understandings.
